These are the General terms and Conditions of sale of Lemej. These conditions will apply to all orders placed by you at www.lemejamsterdam.com, offers, agreements and other statements under which Lemej deliver Products to the Customer, except where specified otherwise in writing by Lemej. These conditions, are applicable under Dutch Law and Jurisdiction.
Intellectual property rights concerning documents included on the website and any item created for this website are the sole property of Lemej. Lemej does not grant any licence or any right other than the right to consult the Website. No part of the Website may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any manner whatsoever, except for personal and private use, without the prior written consent of Lemej. This prohibition also includes framing any content from the Website, as well as unauthorized linking.
You can review the most current version of the Terms of Service at any time at this page. Lemej reserves the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

1. General
These conditions apply to all sales and agreements between Lemej and the consumer, whereby Lemej will apply these conditions unless agreed otherwise in writing. By placing an order, the customer agrees to the applicability of these Conditions to the contract entered into between the customer and Lemej.
2. Orders and delivery
The individual Customer can place his order at Lemej by Internet 24 hours a day, 7 days a week. Once an order has been placed, the consumer will directly receive an email to confirm the details of the order and the total costs associated with the order. Lemej will make every effort to process and deliver your order as well and as quickly as possible after receiving full payment. All orders will be sent within five working days after receipt of payment by the consumer. In the case of technical malfunction, however, which falls under the category of circumstances beyond Lemej’s control, an order will be shipped as soon as possible. We strive to keep our website (www.lemejamsterdam.com) as current as possible. However, the possibility remains that a certain product is no longer available, in which case we will contact the consumer as soon as possible.
An order/agreement by Customer will come into force at the date Lemej confirms the order in writing or via e-mail, as far as none of the exceptions in this Article apply.
Lemej reserves the right not to accept your order in the event, for example, that we are unable to obtain authorization for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn.
Lemej reserves the right to cancel any order prior to dispatch should we find that the price is incorrect. In such case we will notify Customer by email and give you the option to place a new order for the correct price. If we are unable to contact you, your order will be automatically cancelled.
An order confirmation by Lemej is considered to be an accurate and complete representation of the order. If Lemej starts, delivery of the Products, or sends an invoice, these acts are considered to be of equal status as an order confirmation.
Orders will be delivered to the shipping address indicated by the customer and via the means of delivery chosen by the customer. The delivery period as shown on the website is an indication. External factors, such as internal availability as well as the payment and means of transport chosen by you, may affect the delivery period.
All countries within the European Union are shipped on DDP (Delivery Duty Paid) basis, which means that taxes and duties are included in the final price. Important: Some countries outside the European Union, e.g. the United States, require an import duty payment upon arrival of your order. Lemej does not reimburse these costs. Lemej has no influence or control over such duties and will therefore not be able to inform you thereof. Before placing such an order, you must check yourself whether the items ordered by you can be exported to or imported in the country in question and what the cost is thereof.
Lemej takes great care to ensure that its products are shipped correctly and completely. Should you unexpectedly receive incomplete or damaged products, please contact Lemej within 2 days after receiving your order.
All orders are fully traceable through your tracking code. Delivery times are provided as guidelines only, and do not take into account possible delays caused by payment authorization and/or stock availability.

3. Prices and payment
All prices indicated on Lemej’s website are in Euro’s and include any Value Added Tax (VAT). Delivery costs shall be added to the price of the products and are indicated separately on the order confirmation/ invoice.
Customers are able to pay for their order in the way indicated in the Lemej webshop.
Every order implies acceptance of the prices and description of the products available for sale. Any dispute on this point will intervene within the framework of a possible exchange and guarantees mentioned below.
In every case, the supply online of the bankcard number and the final validation of the order by the Customer will constitute proof of the order and current liability for the sums for the products selected in the order. This validation constitutes signature and acceptance of all the operations carried out on the www.lemejamsterdam.com site.
5. Returns
Lemej will gladly accept returns. If for any reason you are not satisfied with the product you ordered, you have the right, without giving any reasons, within fourteen days after receiving the product to indicate that you wish to terminate the contract with regard to the product in question. This concerns the so-called time to reconsider. You may use your right to termination by giving any unequivocally declaration to Lemej of your termination. Please return all items in its original packaging and with the original hangtags. Lemej will not accept any items that have been washed, worn, stained, damaged or altered in any way. Items that do not meet these conditions will be returned to the sender.
Exchanging an item for a different style is not possible. In that case the order will be refunded, any new items can be bought in the online store.
Please use the return form you find attached to your order to return your item(s).All returns should be accompanied with the order number, reason of return. Unidentifiable returns may not be possible to refund. Returns will be handled within 5 working days from receiving the return. The returned items will be refunded to the same card or account that they were paid from. Shipping costs will not be refunded.
Lemej recommends sending your return with traceable post, so please keep your track & trace receipt to track your order. We have no information on your return while it is on its way to us. Shipping costs for returning are the responsibility of the customer. Lost packages will not be refunded.

6. Transfer of Ownership
Ownership of merchandise will not be transferred until the associated obligations of purchaser have been fulfilled. At the point of transfer of ownership, which is at the point of delivery of the articles, product liability is transferred to the purchaser.
7. Money Back Guarentee
If the consumer, for whatever reason, does not wish to retain the article, the consumer has the right to return the article to Lemej within fourteen working days after taking delivery of the article. The consumer must first inform Lemej in writing via email of their intention, and must follow all further return conditions and instructions stipulated by Lemej. This guarantee does not comply if the article has been damaged, washed, or if the consumer has attempted to mend or alter the article in any way. Return articles will only be accepted if it is sent in the original, undamaged wrapping and the labels are still attached to the merchandise. The shipping costs of the returned merchandise will be entirely paid for by the consumer. Under no circumstances will Lemej reimburse the shipping costs of returned merchandise. If the return instructions have been followed accurately, Lemej will reimburse the consumer for the returned article(s) within thirty days after receiving it. If a payment is completed by credit card, refunds will automatically be applied to the credit card used by the customer at the time of purchase.

9. Privacy
Lemej finds it very important to ensure that all of the consumer’s personal information is treated with the utmost care and security. Lemej will not give the consumer’s personal information to third parties, except when the information is required for the delivery of the order.
When placing an order, Lemej requires the consumer’s name, invoice and delivery addresses, and payment details so that the order can be processed. The payment details will only be used to conclude the payment process.
If the consumer subscribes to our newsletter, their personal details will be used to keep them informed of changes to our assortment, special offers, website improvements and other relevant information pertaining to Lemej.
Records of website visits are kept for statistical purposes. Information concerning the amount of visitors and visitor frequency to our website will be used for internal research and website improvement. However, this general information is anonymous and cannot be traced back to the individual visitor.
10. Liability
All articles in the collection of Lemej have been produced with the greatest love and care. Lemej cannot assume any liability for damages in any form whatsoever, either physical, material or immaterial, that can be caused by malfunctioning or ill use of the articles sold by Lemej and/ or materials or accessories becoming undone. The content of the website has been compiled with the greatest care. However, Lemej cannot preclude the possibility of any error or incompletes in the information on the website (www.lemejamsterdam.com). Lemej cannot assume any liability for the consequences of incorrect or incomplete information on the website. Lemej cannot be held responsible for any typing or misprinting errors that could communicate an incorrect selling price. In that case Lemej will adjust the price as soon as possible. The actual colour of the products can differ from the colours shown on the computer /mobile phone screens. Lemej cannot be held responsible for variations in colours as a consequence of the quality of the computer/mobile phone screens. The position and size of the actual prints on the feeding shawls can differ slightly from the display on the website. Lemej cannot be held responsible for this. Certain links on the website can give access to websites and information that is being exploited and maintained by third parties. Lemej does not control these sites and it not responsible for the content of these sites.
Lemej is not liable for incorrect use of the delivered Products by Customer or for use of the delivered Products for a purpose which the Product or Service is not suitable for.The exclusions and restrictions referred to in this shall no longer apply if and in so far as the loss is the result of intentional acts or deliberate recklessness on the part of Lemej, it’s management or employees.
11. Force Majeure
Lemej shall not be obliged to meet any obligations, including any guarantee obligation agreed between the Parties, and will not be liable for any damages, if it is prevented from meeting its obligations as a result of force majeure. Force majeure shall include: a situation of force majeure encountered by Lemej’ own Suppliers, failure by secondary Suppliers engaged by Lemej on the Customer’s instructions to duly meet their obligations, the defectiveness of items, hardware, software or materials provided by third Parties that Lemej has been instructed to use by the Customer, government measures, electricity failure, faults affecting the internet, computer network or telecommunication facilities, war, workload, strike action, general transport problems and the unavailability of one or more members of staff.
If a situation of force majeure lasts for longer than ninety (90) days, either of the Parties shall be entitled to terminate the Agreement in writing, without being liable to the other Party. Customer is not entitled to suspend or postpone the payment of any Products already delivered by Lemej and Lemej will in case necessary send an invoice to Customer for these Products.
12. Copyright
All intellectual property rights provided by Lemej under the agreement to the Customer including but not limited to trademarks, patents, copyrights, design rights, trade secrets, logo’s, software, source codes, data files, hardware or other materials such as analyses, designs, documentation, reports, quotations and related preliminary material developed shall remain exclusively vested in Lemej, its licensors or its Suppliers. The Customer shall only acquire those rights of use that are explicitly granted in the agreement/order, these Term and Conditions and by law. Any rights of use granted to the Customer shall be non-exclusive, non-transferable, non-assignable to third Parties and non-sub licensable.
13. Acceptance of General Conditions
All website users are required to be aware of, and to agree with, all of the above General Terms and Conditions. By placing an order with Lemej, the consumer automatically agrees to all of our General Terms and Conditions. Lemej’ client’s details are automatically stored in our client list.
